Dog Bites and the Law in South Africa

South African law takes a firm line on dog attacks. Under the long-standing actio de pauperie principle, an owner can be held liable for harm caused by their domestic animal acting contrary to its nature, even where the owner was not negligent. In practice that means "I did not know he would do that" is usually not a defence.

If your dog bites someone

Secure the dog immediately and separately.
Help the injured person get medical attention. Bites become infected fast and many need antibiotics.
Exchange details. Do not admit liability on the spot, and do not argue.
Provide your dog's rabies vaccination record — this is the first thing a doctor and a health inspector will ask for.
Photograph the scene, including where the dog was contained and any signage.
Notify your insurer. Some household policies cover this and some exclude certain breeds.

If you are bitten

Wash the wound thoroughly with running water and soap for several minutes, then see a doctor the same day. Ask about tetanus and about rabies — rabies occurs in South Africa, particularly in KwaZulu-Natal, the Eastern Cape and Limpopo, and post-exposure treatment is urgent and effective. Get the owner's details and the dog's vaccination status. Report to the SAPS if it was serious or if the owner is uncooperative, and to the municipality's animal control.

Reducing the risk as an owner

Secure fencing and a gate that latches. Most bites involve someone at a gate or a dog that got out.
Signage at the entrance.
Control at delivery time — a specific place the dog goes when the bell rings.
Sterilisation, which reduces some hormonally driven aggression.
Socialisation and training from young.
Never leave dogs and small children unsupervised, whatever the breed and whatever the history.

The warning signs people miss

Dogs almost always signal before they bite: stiffening, a hard stare, freezing over food, a low growl, lip curl, whale eye where the whites show. Punishing a growl teaches a dog to skip the warning, which produces the "bit with no warning" cases. Never punish a growl — respect it, remove the trigger, and get help.
