If Your Dog Bites Someone in South Africa

The liability position

South African law recognises a long-standing claim, the actio de pauperie, under which the owner of a domestic animal can be held liable for harm it causes even without negligence on the owner’s part.

Certain defences exist — for example where the injured person provoked the animal, or was unlawfully on the property. But the starting position is that the owner carries responsibility.

A separate claim in negligence may also be brought where the owner failed to take reasonable care, such as leaving a gate open.

Immediate steps after a bite

Rabies status matters enormously

A current rabies vaccination changes the medical decisions the injured person faces. Without proof, they may need a full course of post-exposure treatment and your dog may face observation or quarantine.

This is one of several reasons the vaccination is legally compulsory here. Keep the card where you can find it.

Municipal consequences

Municipal bylaws commonly provide for a dog to be declared dangerous after a biting incident, with conditions attached — secure enclosure, muzzling in public, or in serious cases destruction.

Cooperating fully with the municipality and demonstrating that you have taken steps materially affects the outcome.

Reducing the risk

Most bites happen to people the dog knows, in the dog’s own home, and most were preceded by warning signals that were missed.

Learn your dog’s early stress signals — lip licking, turning away, whale eye, stiffening. A dog that growls is communicating, not misbehaving, and punishing a growl removes the warning without removing the feeling.

Manage rather than test. Gates, separate spaces at mealtimes, and never leaving young children and dogs together unsupervised prevent far more bites than training alone.
