How Many Dogs Can You Legally Keep?

Most South African municipalities set a limit on how many dogs may be kept on a residential property without a permit. Almost nobody knows what their limit is until a neighbour complains.

The general picture

Typical by-laws allow around two to four dogs over a certain age on an average residential erf, with the number sometimes scaling by property size. Above that limit you generally need to apply for a permit or exemption, which may involve an inspection, neighbour consultation and a fee.

Numbers, ages and processes differ by municipality — Johannesburg, Tshwane, Ekurhuleni, Cape Town, eThekwini and smaller municipalities all have their own animal by-laws. Search for your municipality's animal or dog by-law specifically, or phone the municipal call centre and ask for environmental health.

Sectional title and estates

Complexes and estates layer their own conduct rules on top, and those are often stricter — frequently one small dog, sometimes none, usually requiring written trustee consent. Body corporate rules are enforceable and a breach can escalate to a legal process. Read them before you move in, not after.

What triggers enforcement

Almost always a complaint — usually about barking, smell, or dogs getting out. Officials rarely audit proactively. That means the practical protection against enforcement is being a good neighbour: manage noise, keep the property clean, and keep the dogs contained.

If you are over the limit

Apply for the permit rather than waiting. A proactive application with a clean, well-managed property, sterilised and vaccinated dogs, and no complaint history usually goes fine. Being discovered is a much worse starting point, and outcomes can include being ordered to reduce numbers.

The welfare angle

The limits exist partly because of hoarding, which is a genuine and sad problem. If you find yourself with more animals than you can afford to feed, vaccinate and sterilise, contact a welfare organisation early. They deal with this constantly and they are far more interested in helping than in judging.

Practical advice

Whatever the legal number, the real limit is how many you can properly care for — vet care for each, individual attention, and a plan for what happens if you are ill or need to move. Three well-managed dogs are a better outcome than six struggling ones.
