Renting With Pets: What Tenants Should Know

Finding a rental that accepts pets is one of the most common reasons South African animals end up in shelters. It is worth understanding what is negotiable and what is not.

The lease is what governs

There is no automatic right to keep a pet in a rented property. If the lease prohibits pets, keeping one is a breach and can be grounds for cancellation. If the lease is silent, get written permission anyway — a verbal yes from an agent who leaves the company is worth nothing.

Where the property is in a sectional title scheme, the body corporate conduct rules apply on top of the lease, and the landlord cannot give you permission the scheme rules do not allow.

Deposits and damage

Landlords commonly ask for an additional pet deposit. The Rental Housing Act framework requires deposits to be held in an interest-bearing account and returned, less legitimate deductions for damage, within set periods after the lease ends. Deductions must be for actual damage supported by receipts, not for normal wear and tear.

Do a thorough incoming inspection with photographs, including the garden and gates, and insist on a joint outgoing inspection. This is where most pet-related disputes are won or lost.

How to negotiate a yes

Practical protections

Check the gate and fence before you sign and ask in writing who is responsible for repairs. Ask specifically whether the garden service uses snail bait or herbicides. Get any pet permission recorded in the lease itself or in a signed addendum, not in a WhatsApp message.

If you have to move and cannot take them

Contact breed-specific rescues and your local welfare organisations early, and be honest about the timeline. Surrendering an animal responsibly with full history is far better than abandoning it or passing it to a stranger from a free-to-good-home advert, which is a well-known route into dogfighting and bait use.
